These Terms and Conditions (“Terms”) govern all reservations, bookings, and stays at Real Texas Lake Living (the “Property”), located at 120 Aqua Way, Kingsland, Texas 78639, in Llano County, Texas, and deeded and owned by Real Texas Lake Living, LLC (“Owner”). By booking, paying for, accessing, or occupying the Property through this website, Airbnb, Vrbo, or any other booking platform, the person making the reservation (“Primary Guest”) and all members of the guest’s party agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, do not book or occupy the Property.

1. Agreement to Terms

By renting, booking, paying for, entering, or staying at the Property, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. The Primary Guest accepts these Terms on behalf of all occupants, visitors, and invitees associated with the reservation.

2. Nature of Stay

This is a short-term vacation rental for temporary lodging only. This agreement does not create a landlord-tenant relationship, tenancy rights, or any right to remain beyond the booked stay.

3. Minimum Age Requirement

The Primary Guest must be at least 25 years old to make a reservation and must remain at the Property for the duration of the stay.

4. Maximum Occupancy

Maximum occupancy at the Property is 16 persons total, including overnight guests and any permitted visitors. Exceeding the maximum occupancy at any time is a material violation of these Terms and may result in immediate termination of the reservation, removal from the Property, and forfeiture of all amounts paid.

5. Visitors

Visitors are permitted only so long as total occupancy at the Property never exceeds 16 persons. The Primary Guest is fully responsible for the conduct of all visitors and guests while on the Property.

6. No Parties or Events

Parties, events, receptions, celebrations, commercial gatherings, and unauthorized group functions are strictly prohibited. Any party or event, or any behavior that Owner determines is disruptive, unsafe, excessive, or inconsistent with residential use of the Property, will constitute a material breach of these Terms and may result in immediate removal without refund.

7. Booking, Payment, and Card on File

All reservations must be paid in accordance with the booking terms presented at the time of reservation. By making a reservation, the Primary Guest authorizes Owner and/or the booking platform to charge the payment method on file for:

  • the rental amount,
  • applicable taxes and fees,
  • damage to the Property,
  • missing items,
  • excessive cleaning,
  • extra cleaning required due to smoke, trash, spills, stains, or misuse,
  • unauthorized occupancy,
  • policy violations,
  • and any other costs incurred as a result of a breach of these Terms.

8. Cancellation Policy

Cancellations made 30 days or more before the rental start date are eligible for a 100% refund of amounts paid, excluding any non-refundable third-party processing fees if applicable.

Cancellations made less than 30 days before the rental start date are non-refundable.

No refunds will be given for:

  • early departures,
  • no-shows,
  • weather,
  • lake conditions,
  • road conditions,
  • utility outages outside Owner’s control,
  • mechanical failures outside Owner’s control,
  • or any other circumstance not expressly stated in these Terms.

9. Check-In and Check-Out

Check-in begins at 4:00 PM on the arrival date.

Check-out is no later than 11:00 AM on the departure date.

Early check-in or late check-out is not guaranteed and must be approved in writing in advance. Unauthorized late check-out may result in additional charges.

10. Quiet Hours

Quiet hours are from 10:00 PM to 8:00 AM daily. Guests and visitors must respect neighboring properties and avoid noise, music, shouting, outdoor disturbances, or any conduct that may unreasonably disturb others.

11. No Smoking

Smoking is strictly prohibited anywhere on the Property. This prohibition includes, without limitation, cigarettes, cigars, pipes, vaping, e-cigarettes, marijuana, and any other smoking or inhaled substance.

Any evidence of smoking or vaping on the Property may result in additional cleaning, deodorization, remediation, and damage charges billed to the card on file.

12. No Pets

Pets are not allowed anywhere on the Property. Unauthorized animals constitute a material violation of these Terms and may result in additional cleaning charges, damage charges, and/or immediate termination of the stay without refund.

13. Parking

Parking is limited to a maximum of 6 vehicles. Guests may park only in designated and lawful areas of the Property. No parking in a manner that blocks access, damages landscaping, violates local rules, or creates a hazard is permitted.

14. House Condition and Guest Responsibilities

Guests agree to keep the Property in a clean, safe, and reasonably orderly condition throughout the stay. Guests are responsible for:

  • leaving the Property in substantially the same condition as received, ordinary wear excepted,
  • locking doors and securing the Property when away,
  • using all amenities, appliances, furnishings, and equipment properly,
  • reporting damage, malfunction, or unsafe conditions promptly,
  • and supervising children at all times.

The Primary Guest is responsible for any damage, stains, odors, breakage, loss, theft, or excessive mess caused by any guest, visitor, or invitee during the stay.

15. Pool, Spa, Dock, Lake, Waterfront, and Water Activity Risk

The Property includes access to a pool, spa, dock, waterfront, and lake-related areas and amenities. Use of all such areas and amenities is entirely at the guest’s and visitors’ sole risk.

There is no lifeguard and no on-site supervision provided. Owner does not supervise use of the pool, spa, dock, waterfront, lake access points, or any related equipment or recreational activity. The Property may contain wet surfaces, uneven surfaces, stairs, watercraft-related hazards, changing water depth, submerged objects, slippery decking, and other obvious or hidden hazards that can result in serious injury, drowning, death, or property loss.

By booking or occupying the Property, the Primary Guest and all occupants and visitors expressly acknowledge and agree that:

  • use of the pool, spa, dock, waterfront, lake, and surrounding outdoor areas is voluntary and at their own risk;
  • children must be actively supervised by a responsible adult at all times;
  • diving, running, horseplay, intoxicated use, and unsafe conduct are strictly prohibited;
  • life jackets and appropriate safety measures should be used whenever appropriate;
  • lake conditions, weather, water depth, current, boat traffic, wildlife, and water quality can change without warning;
  • Owner makes no representation or warranty that any water-related feature or area is safe for any particular use at any particular time.

To the fullest extent permitted by law, the Primary Guest, for themselves and on behalf of all occupants and visitors, assumes all risk of injury, death, or loss arising from or related to use of the pool, spa, dock, waterfront, lake access, and any water-related amenity or activity at or near the Property.

16. Release and Indemnification

To the fullest extent permitted by law, the Primary Guest, for themselves and on behalf of all occupants and visitors, agrees to release, defend, indemnify, and hold harmless Owner, Real Texas Lake Living, LLC, and their respective agents, representatives, contractors, affiliates, and property managers from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • the guest’s or any visitor’s use or occupancy of the Property,
  • any injury, death, or property damage occurring at or near the Property,
  • use of the pool, spa, dock, waterfront, or lake,
  • violation of these Terms,
  • or any act, omission, negligence, or misconduct of the guest, occupants, or visitors.

This provision does not apply to the extent prohibited by law.

17. Maintenance, Repairs, and Interruptions

Owner will use reasonable efforts to maintain the Property and address reported issues in a commercially reasonable manner. However, Owner does not guarantee that all amenities or systems will be available at all times and shall not be liable for temporary failures or interruptions involving, by way of example:

  • internet or Wi-Fi,
  • cable or streaming services,
  • appliances,
  • HVAC,
  • pool or spa heating,
  • utilities,
  • water service,
  • or conditions affecting the lake or outdoor amenities,

when such issues are outside Owner’s control or cannot reasonably be remedied immediately.

Such issues do not entitle guest to a refund, credit, or cancellation unless required by law or expressly approved by Owner in writing.

18. Entry by Owner or Manager

Owner or Owner’s authorized representatives may enter the Property when reasonably necessary for inspection, maintenance, repairs, emergency response, protection of persons or property, or enforcement of these Terms.

19. Prohibited Conduct

The following are strictly prohibited:

  • illegal activity of any kind,
  • parties or events,
  • exceeding occupancy limits,
  • smoking anywhere on the Property,
  • pets,
  • dangerous, reckless, or nuisance behavior,
  • tampering with safety devices,
  • use of fireworks or open flames,
  • commercial filming or photography without written permission,
  • subletting or transferring the reservation,
  • and any conduct that may damage the Property or disturb neighbors.

20. Personal Property

Owner is not responsible for loss, theft, or damage to guest belongings, vehicles, trailers, boats, or personal property of any kind. Guests are solely responsible for safeguarding their property.
